Terms of Service

These terms apply to all users of the AATI platform at aatiupskill.com.

These Terms of Service (“Terms”) govern your use of the AATI Platform at aatiupskill.com. By creating an account or using the Platform, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

AATI provides an online learning platform offering agribusiness-related courses, e-books, and related educational resources to learners in Kenya and beyond, delivered by instructors affiliated with AATI.

3. Eligibility and Account Registration

You must be at least 18 years old to create an account, or have the consent and involvement of a parent or guardian if you are younger. You agree to provide accurate and complete information when registering, and to keep your account information up to date. Each account is for individual use only; you may not share your login credentials with another person. Instructor and administrator accounts are created by invitation only and are subject to additional internal verification.

4. Your Account and Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. If you believe your account has been accessed without your authorization, you must notify us immediately.

5. Course Purchases and Payments

Course prices are listed in Kenyan Shillings (KES). Payments are processed securely through our payment partner, Paystack. Once a purchase is completed, you are granted access to the corresponding course content for as long as your account remains active and in good standing, unless otherwise stated for a specific course.

Refunds: If you experience a technical issue preventing you from accessing a purchased course, or wish to request a refund, contact us within 7 days of purchase through the Help Desk. Refund requests are reviewed on a case-by-case basis and are generally only granted where a course has not yet been meaningfully accessed.

Free courses remain free and do not require payment.

6. Course Content and Intellectual Property

All course content, including videos, text, quizzes, and downloadable materials, is owned by AATI or the instructor who created it, and is protected by copyright and other intellectual property laws. When you enroll in or purchase a course, you are granted a personal, non-transferable, non-commercial license to access and use that content for your own learning. You may not copy, redistribute, resell, publicly share, or use course content for any commercial purpose without our prior written permission.

7. Your Content

Any notes, messages, or support ticket content you submit remain yours, but by submitting them you grant AATI a license to store, display, and use them as needed to operate the Platform (for example, showing your notes back to you, or allowing an instructor to view a support ticket you’ve raised about their course).

8. Instructor Terms

If you are an instructor, you confirm that you own or have the right to use all content you upload, and that it does not infringe on any third party’s rights. Instructor-submitted courses are subject to review and approval by AATI’s administration team before being published to learners. AATI reserves the right to reject, request changes to, or remove any course content that does not meet our quality or content standards.

9. Prohibited Conduct

You agree not to: share your account credentials with others; attempt to access another user’s account or data without authorization; upload harmful, illegal, or infringing content; harass, abuse, or send inappropriate messages to other users or instructors; attempt to circumvent payment for paid content; or use any automated system to scrape, copy, or extract data from the Platform.

10. Certificates

Certificates are issued upon successful completion of a course’s requirements. Certificates reflect completion of AATI’s training only and do not constitute a guarantee of employment, income, or any specific outcome.

11. Suspension and Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Platform. You may close your account at any time by contacting us.

12. Disclaimers

The Platform is provided “as is.” While we work to keep it reliable and available, we do not guarantee uninterrupted or error-free access at all times.

13. Limitation of Liability

To the maximum extent permitted by Kenyan law, AATI’s total liability to you for any claim arising from your use of the Platform is limited to the amount you have paid us in the twelve months preceding the claim.

14. Governing Law

These Terms are governed by the laws of the Republic of Kenya.

15. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
